Does your organisation need to appoint a Data Protection Officer?

Under the GDPR (Article 37), there are three main scenarios where the appointment of a DPO by a controller or processor is mandatory:

  1. The processing is carried out by a public authority.

  2. The core activities of the controller or processor consist of processing operations which require regular and systematic processing of data subjects on a large scale.

  3. The core activities of the controller or processor consist of processing on a large scale sensitive data or data relating to criminal convictions / offences.

Definitions as published by the Article 29 Working Party (“WP29”) :

  • Core Activites – Part of the key operations to achieve the controller / processor’s objectives. Excluding activities such as payroll or IT support which are additional functions.

  • Large Scale – a) The number of data subjects b) The volume of data or data item range c) The duration of the processing d) The geographical extent of the processing.

     

  • Regular and Systematic Monitoring – All forms of tracking and profiling on the internet, both online and offline and recurring or periodically taking place in accordance to an organised or methodical system / strategy. 

     

Determining whether or not you need to appoint a DPO depends on the scope and scale of your data processing, and whether or not they are pertained within the reach of Article 37.

If your organisation believes it is not neccesary to appoint a DPO the WP29 reccommends documenting why you belive your organisation falls outside the scope of Article 37.
